Terms of use and sale

1. Publisher and purpose

The "Spin Coach" service (the "Service") is published by VMSI, trade name of Vincent Maurel, sole proprietor registered in France under SIREN number 901 847 053, with registered office at 87c route de la Luye, 05000 Gap, France (the "Publisher"). These terms govern access to the Service, a web application for analysing poker hand histories and training away from the tables, as well as paid subscriptions. Signing up means accepting these terms in full.

2. Access conditions

• The Service is reserved for natural persons aged 18 or over with full legal capacity.
• Signing up requires a valid email address and a password. Users are solely responsible for keeping their credentials confidential and for any activity carried out from their account.
• One account per person. The Publisher may suspend an account in case of credential sharing, fraud or breach of these terms.

3. Nature of the Service and poker room rules

Spin Coach is a post-session analysis and training tool. It provides no assistance while you play, does not interact with poker room software and displays no real-time information at the tables. Users remain solely responsible for complying with the terms of the rooms they play on, including regarding the use of the hand history files those rooms provide.

The reference ranges and analyses are educational decision aids. They guarantee no financial outcome. Poker carries a risk of losing money and of addiction.

4. Free trial, plans and prices

• Every new account gets a 14-day free trial with the features of the Pro plan, with no payment method required. When the trial ends, the account automatically moves to the free "Explorer" plan.
• Plans, their features and their prices are described on the Pricing page. Prices are shown in euros, all taxes included.
• The Publisher may change prices; the new price applies to the following period after the user has been informed at least 30 days in advance, and the user may cancel at no cost.

5. Subscription, payment, renewal, cancellation

• Subscriptions are monthly or yearly, paid in advance by card through the provider Stripe Payments Europe, Ltd. (Dublin, Ireland), and renew automatically for an identical period.
• Users may cancel at any time from "My account". Cancellation takes effect at the end of the current period; no pro-rata refund is due unless the law provides otherwise.
• If a payment fails, access to paid features is kept for 7 days, after which the account moves to the free plan until the situation is resolved.
• An invoice is available for every payment from "My account".

6. Right of withdrawal

In accordance with article L221-28 of the French Consumer Code, users acknowledge that supply of the Service begins immediately after payment and expressly waive their 14-day right of withdrawal for the current period. The free trial allows the Service to be tested before any payment.

7. User content and data

• Users keep ownership of the hand histories they import. They grant the Publisher a limited, non-exclusive licence for the sole purpose of providing the Service (analysis, statistics, training).
• The screen names of other players appearing in the histories are pseudonymised and used only in aggregate form. Users must not use the Service to build individual profiles of third parties.
• Processing of personal data is described in the privacy policy.

8. Intellectual property

The Service, its code, interface, texts, reference ranges and analyses are protected by copyright and remain the property of the Publisher or its licensors. Any reproduction, extraction or resale, in particular of the reference ranges, is prohibited without written permission. "Spin & Go" and the names of the rooms mentioned are trademarks of their respective owners, unconnected with the Publisher.

9. Fair use

The following are prohibited: circumventing the limits of a plan; automating access to the Service outside the features provided; attempting to access other users' data; disrupting the operation of the Service; using the Service in breach of a poker room's rules or of the law.

10. Availability and liability

The Publisher endeavours to provide continuous access to the Service but does not guarantee the absence of interruption (maintenance, incident, force majeure). Analyses rely on the files provided by the rooms and on simplified models; the Publisher cannot be held liable for users' playing decisions or losses. The Publisher's liability is in any event limited to the amounts paid by the user over the last twelve months.

11. Account deletion

Users may delete their account at any time from "My account"; their data is then erased under the conditions of the privacy policy. The Publisher may close an account inactive for more than 24 months after notice, or immediately in case of a serious breach of these terms.

12. Changes to these terms

The Publisher may amend these terms. Users are informed by email at least 15 days before they take effect; continued use constitutes acceptance.

13. Governing law and mediation

These terms are governed by French law. In case of a dispute, users may refer the matter free of charge to the consumer mediator [MEDIATOR NAME, CONTACT DETAILS], after first filing a written complaint with the Publisher. Failing that, the French courts have jurisdiction. The French version of these terms is the legally binding one.
